I seem to get this error any ideas?

Can you check a few things for me?
1. Go to your data folder, and see what the read-write permission is for all the files in that directory. It should be set to CHMOD 777 if that's not already the case.
2. Open notepad and create a file (call it phpinfo.php), and enter the following into it:
Upload it to your website, and access the file through the browser. Save the output as an html file, and mail it to us as webmaster@digioz.com . I will be happy to take a look at it for you to see if your PHP setting is missing anything.

we are on a dedicated windows 2003 Enterprise server

For Windows 2003, please check the Read / Write / Execute Permission for the data files by right clicking on the files, choosing "Properties", and clicking on the "Security" tab. Make sure that the "IUSER_MachineName" (default IIS user) has "Read, Write and Execute" permissions on the data folder and all the files under it.
The phpinfo() part still applies to you as well.

i checked and data folder and all others files have read write and excute from the iuser
